About

My name is Jonathan D.W.S. Ross. I am a multidisciplinary artist living as a guest in the unceded traditional territories of the Lekwungen people of the Songhees nation, though I was born and raised among the Dane-zaa people and in their lands.Being a broad generalist and eclectic artist I find it hard to categorize myself and my art, but simply put I am an illustrator, photographer, and painter. Much of my work delves into traditional mediums like watercolour, gouache, pencil and ink drawing, and film photography, as well as more contemporary mediums such as digital illustration via Procreate and Photoshop, pixel art, digital cartography, digital photography, and digital manipulation.My main focus is typically character art and dark art though I love to branch out in various directions and explore areas such as album cover art, comics, portraits of people and pets, mixed media, and animation. I am an avid explorer of various styles of art and illustration.This life and world has far too much to offer a simple artist who is not content to sit and try only one of the myriad options available.

Terms of Service

Don't worry, you won't find 20 pages of 'Legalese' text here.
The following Terms of Service are meant to clarify and keep you informed about the process and the terms I operate under.
This is a work in progress and subject to change.


General

If you wish to post the commission on social media please be sure to credit me:
@moonstoneghosts and/or @mintymitani
Do not remove any signature or watermark, and do not claim the artwork as your own. Plagiarism will not be tolerated. If you are found to be plagiarising my work, your name and information will be added to community blacklists.You may crop the artwork to use as an icon or profile picture.
Do not edit my artwork for any reason (color changes, filters, tracing, collage, etcetera).


Process

  • Commissions may be done under a peer-reviewed contract (< link to document) designed to ensure clear terms of our work agreement, mutual assurance, and is intended to protect us both.

  • You will be involved throughout the process with regular updates, check-ins, and opportunities for your input and feedback.

  • Communication is essential to this process. I will try my best to make myself available for you to contact regarding the commission, I ask that you also do the same for me. Work time will be significantly increased if there are long delays in communication.

  • There will be three significant points in the process, at which you will receive:

  • One or more sketches for you to choose from.

  • One or more process updates during which you can offer input for some corrections and adjustments.

  • One finalized submission, allowing for very minor adjustments or corrections.

  • My turn-around work time varies depending on the scope of the commission, depending on scope, complexity, and communication time. the scope.

  • My illustrations are typically in the range of 3000x3000 pixels at 300dpi resolution. If you want your piece to be of a certain size let me know at the beginning.

  • All commissions, when complete, will be delivered to you as a high resolution digital file (.tiff and/or .png) through either e-mail or as a Google Drive link.

  • I also offer high quality digital press prints and giclée prints. Prints are available in standard sizes (8"x10", 11"x14", 13"x19"). Prints can be made on standard coated or uncoated papers, as well as on speciality papers such as vellum, silver paper, kraft paper, wood veneer, hot or cold press cotton rag paper, canvas, and much more.

Our Rights

  • All prices shown are for commissions intended for personal use and display. You can not use any personal use artwork for your own economical benefit (mass producing merchandise, t-shirts, prints, mugs, album or book covers, promotional artwork, game illustrations, etc) unless commercial use was agreed upon between us before work began. Any work intended for commercial use is subject to different fees and terms to be discussed. If any personal use work is found to be used in a commercial use fashion, you will be invoiced for either the difference in fees subject to reasonable discretion from the artist or a royalty percentage of all commercial uses of the artwork. If the fees are not paid in full within one week (7 days) legal action may be pursued.

  • I retain the creative rights for the commissioned work, meaning that I can use it on my portfolio, on my commission sheet, for promotion purposes, etc.

  • I will never re-sell, gift, or otherwise offer your commissioned piece to anyone else for any reason.

  • At any point in the process, we both have the right to kill-switch the process and withdraw from the contract. This is a last resort option after discussions have failed. Any payments already made for work completed are non-refundable, but no further payments are required. If you choose, you may still have access to any work I had completed up to that point.

It is hereby agreed that the undersigned of the commission form is commissioning Jonathan Ross (aka Moonstone Ghosts), the artist, for the production of custom artwork. The artwork will be produced in agreed upon materials and dimensions as per the commission form. The artwork is to contain agreed upon scope and specific details as per the commission form and will be produced for the non-refundable fees discussed before any work shall commence.-- Fee and Work Schedule --1) Upon receipt of 25% of the total fee the artist will provide approximately three (3) sketches with options for the foreground as well as the background. The client may either choose one sketch to be completed, select features of multiple sketches to be combined into a new sketch, or request a modification of an existing feature. The artist may waive the initial fee at their discretion.2) When the sketch has been completed to the satisfaction of the client 50% of the total fee is to be paid. Upon receipt of the payment work will begin on the final artwork. Progress updates will be provided at a minimum of two (2) intervals during the process, typically with the completion of the lineart and completion of colouring. The client may request minor to moderate changes at these points, however a major change may require renegotiation of the timeframe and fee and further alteration requests beyond these are subject to further fees of up to 25% of the total fee depending on the scale and scope of the requested changes.3) When work on the final artwork is complete a low resolution version will be e-mailed to the client for final approval. By giving final approval the client is agreeing that the work is complete and the final payment of the remaining 25% of the total fee is due. Once the fee is paid in full the artwork will be provided in the form of a high resolution file (.png or .tiff, or other file format as requested) e-mailed to the client and/or access to a downloadable file provided, and/or a high quality print to be shipped to a valid address given to the artist by the client if print options were discussed and agreed upon. If shipping outside of Canada, there may be additional fees to cover the expenses of shipping/handling.4) Upon receipt of the final print the client is authorized to make use of the artwork for the purposes agreed upon as being either for personal use or commercial use. Ownership of the copyright as well as the right to use the artwork for promotional purposes remains with the artist unless ownership transfer is agreed upon for use in commercial purposes. Any personal use artwork used in a commercial use manner is subject to the fines and fees laid out in the Terms of Service.5) All payments of fees are considered non-refundable. If at any point the client chooses to cancel the contract and forfeit the work done so far any payments already made are non-refundable. If at any point the client has failed to respond to sketches or status updates provided for a period of longer than no more than one calendar month or 31 days, whichever comes first: this contract may be rendered void; all payments made remain non-refundable; further work will require renegotiation.6) By checking the box in the commission form designated "I have read and accept the conditions of the Commission Contract" the client has agreed to these terms and is considered to have signed the contract along with the artist.
